DGMS (Legislative) Circular 02 of 2026 — Appellate authority, composition of offences, penalty officers and belowground working hours
Summary
Addressed to all owners, agents and managers of coal, metalliferous and oil mines. Transmits the Gazette notifications made under the Occupational Safety, Health and Working Conditions Code 2020, which came into force on 21 November 2025, covering the appointment of the appellate authority for mines [S.O. 2488(E), section 111(3)], the officer for composition of offences within their jurisdiction [S.O. 2490(E), section 114(1)] and the officers empowered to impose penalties [S.O. 2504(E), section 111(1)], all published on 13 May 2026. The circular also covers the appointment of Inspectors-cum-Facilitators of mines subordinate to the Chief Inspector-cum-Facilitator, and the limits on working hours — not more than eight hours per shift for persons employed belowground, and not more than five hours of continuous work without an interval of at least half an hour.
